Advertiser Agreement

• LycheeLuxe 的所有官方文件、政策、设置、仪表板和系统通信仅以英文提供。

• Ang lahat ng opisyal na dokumento, patakaran, setting, dashboard, at system communications ng LycheeLuxe ay ibinibigay lamang sa Ingles.

• Semua dokumen resmi, kebijakan, pengaturan, dashboard, dan komunikasi sistem LycheeLuxe hanya disediakan dalam bahasa Inggris.

• Все официальные документы, политики, настройки, панель управления и системные сообщения LycheeLuxe предоставляются только на английском языке.

• Todos los documentos oficiales, políticas, configuraciones, panel de control y comunicaciones del sistema de LycheeLuxe se proporcionan únicamente en inglés.

• เอกสาร นโยบาย การตั้งค่า แดชบอร์ด และการสื่อสารของระบบอย่างเป็นทางการทั้งหมดของ LycheeLuxe มีให้เฉพาะในภาษาอังกฤษเท่านั้น

Between the parties: LycheeLuxe, an online classifieds platform, legally represented by LL - Advertising and Marketing, hereinafter referred to as the "Platform", and the advertiser who electronically accepts this agreement, hereinafter referred to as the "Advertiser", enter into this Advertiser Agreement, which shall be governed by the following clauses:

1. Electronic Acceptance

By checking the confirmation box ("checkbox") on the platform, the Advertiser declares that they have read, understood, and agree to:

• This Advertiser Agreement
• LycheeLuxe Terms of Use
• LycheeLuxe Privacy Policy

The electronic acceptance has the same legal validity as a physical signature, binding the Advertiser to all obligations described herein.

2. Purpose

This agreement authorizes the publication of advertisements by the Advertiser on the LycheeLuxe Platform, including personal information, photos, service descriptions, and contact details, for the purposes of advertising and connecting with potential clients.

3. Advertisement Types, Duration, and Refund Policy

3.1 Available Plans:

Monthly Subscription

Available in all served countries except India. The advertisement remains active for a recurring 30-day period until cancellation by the Advertiser.

Quarterly Package

Available exclusively in India. The advertisement remains active for a fixed period of 90 days (one quarter).

3.2 Refund Policy:

LycheeLuxe operates on a pre-payment model. Refunds are not provided under the following circumstances:

• After the advertisement has been approved and published on the platform.
• For dissatisfaction with the service results or number of contacts received.
• For voluntary cancellation of an active Monthly Subscription or during an active Quarterly Package period.
• For account termination due to violations of this Agreement, the Terms of Use, or applicable law.

A full refund will be issued only if:

• LycheeLuxe rejects the advertisement submission due to non-compliance with platform rules, age verification failure, or legal requirements before its publication.
• A technical error attributable solely to LycheeLuxe prevents the advertisement from being published for the entire paid period, and the issue cannot be resolved.

To request a refund under the eligible conditions, the Advertiser must contact support@lycheeluxe.com within 7 days of the payment date.

4. Advertiser Obligations

The Advertiser guarantees that they:

• Are of legal age according to Brazilian law and the legislation of the country of access.
• All information, photos, and documents provided are truthful and authentic.
• Will not publish illegal, discriminatory, or offensive content, or content involving minors.
• Owns all rights to the submitted content or has authorization to use third-party content.
• Will pay in full for the advertisement prior to publication.
• Will comply with all applicable laws and regulations in the country of access.

5. Platform Obligations

The Platform will:

• Publish the advertisement according to the information provided by the Advertiser.
• Conduct automated and instant identity and age verification via a third-party API (Didit), as detailed in Section 5 of the Terms of Use.
• Remove advertisements that violate Platform rules, Brazilian law, or local laws.
• Protect the Advertiser's data in accordance with the Privacy Policy.

6. Payment

Payment must be made in full prior to publication. All financial transactions are processed securely through the platform's official payment gateways. LycheeLuxe does not charge or process payments via email or telephone.

7. Content Ownership and License

• The Advertiser grants the Platform a non-exclusive, worldwide, and free license to display, reproduce, and distribute the content, solely for the operation of the platform.
• The Advertiser retains ownership of the content, guaranteeing they hold all necessary rights.

8. Limitation of Liability

• The Platform acts only as a space for advertising and connection.
• The Platform is not responsible for services provided by the Advertiser or interactions with clients.
• The Platform may remove advertisements that violate rules or laws without prior notice.

9. Termination

This agreement terminates upon expiration of the advertisement or in the event of violation of the Advertiser's obligations.

After termination, the Advertiser cannot claim any paid amounts, except when the Platform rejects the advertisement due to irregularity.

10. Applicable Law and International Compliance

This agreement is governed by Brazilian law for legal purposes of the Platform. The Advertiser declares and agrees to comply with all applicable laws and regulations of the country of access, including:

• Legal minimum age for escort services
• Protection of minors
• Local advertising norms and service regulations

The courts of São Paulo/SP are hereby elected to resolve disputes related to the Platform.

11. General Provisions

• This agreement constitutes the entire understanding between the parties regarding the subject matter described herein.
• Any modification must be formalized in writing or electronically by the Platform.
• Failure by the Platform to exercise any right does not imply waiver of that right.
