By accessing or using LycheeLuxe services, you agree to comply with these Terms of Use. If you do not agree, do not use the platform.

1. About the Platform

LycheeLuxe is an online classified ads platform that allows companions to create and publish service listings, including contact information and relevant details. The platform does not mediate, facilitate, or participate in any transactions or negotiations between users. Users are solely responsible for any interactions or services provided. The legal responsible for LycheeLuxe is LL - Advertising and Marketing.

2. Eligibility and Age Restrictions

To use the platform, you must meet the legal age requirements of your country of residence and the jurisdiction where you access the platform. Access by minors is strictly prohibited. Age verification may be requested. Accounts that do not meet the requirements will be suspended or terminated. All profiles undergo automated and instant age and identity verification through a third-party Artificial Intelligence (AI) system (Didit), ensuring real-time compliance. Attempts to circumvent this requirement will result in immediate account banning.

LycheeLuxe contacts users exclusively through its official channels: email addresses contact@lycheeluxe.com, support@lycheeluxe.com, report@lycheeluxe.com, legal@lycheeluxe.com, no-reply@lycheeluxe.com and WhatsApp: +55 47 99778-5358. We do not use third-party individuals or unofficial numbers/emails for official communication.

Security Policies:

• We never request confidential information such as credit card details, passwords, or sensitive personal data via email, WhatsApp, or any other messaging service.
• We do not process payments or issue charges via email or phone calls. All financial transactions are handled securely through the platform's official payment gateways.

4. Language Requirement for Support

The base language of the platform is English. To ensure efficient and accurate service, all communications sent to LycheeLuxe support must be conducted in the English language.

5. Profile Verification and Documentation

• All information and documents must be true and authentic. The verification process is carried out by a third-party identity verification service provider (Didit), which acts as a Data Processor under the instructions of LycheeLuxe. Data Isolation and Security:
• Secure Capture: Verification data (document images, selfie, and biometrics) are captured directly from the user's device through a secure SDK and transmitted in an encrypted form (using standards such as AES-256) to Didit's servers, located in the European Union (in compliance with GDPR).
• Exclusive Processing: LycheeLuxe DOES NOT receive, store, or process document images or biometric data on its own servers.
• Result (Log): LycheeLuxe receives from Didit only the final verification result (a log indicating "Approved" or "Rejected") and a unique identifier, which is necessary for account management.
• Immediate Deletion: After the automated verification is completed and the result log is received, the raw data (images and biometrics) are immediately deleted from Didit's systems, in accordance with LycheeLuxe's data minimization policy.

6. User Conduct and Prohibited Content

Users are responsible for all content posted or transmitted. You must not:

• Publish illegal, defamatory, obscene, threatening, abusive, harassing, hateful, or discriminatory content.
• Publish content involving minors (real or simulated sexual exploitation).
• Provide false or misleading information about yourself or services.
• Create fake or multiple profiles.
• Violate third-party intellectual property rights without permission.
• Attempt unauthorized access to other users' accounts or systems.
• Interfere with platform functionality or security.

7. Responsibility for False Information and Consequences

Users are solely responsible for content posted. Violations may result in:

• Immediate ban of the account
• Deletion of content associated with the account
• Reporting to authorities, especially for content involving minors or human trafficking

8. Reporting and Removal of Illegal Content

• Users can report illegal content via the "Report" button or support contact
• Content involving minors is removed immediately
• Reports are handled confidentially

9. Intellectual Property

• All content on the platform (texts, images, graphics, software, etc.) is owned by LycheeLuxe or licensors
• Users grant LycheeLuxe a worldwide, non-exclusive, sublicensable, transferable license to use content for platform operations
• Third-party content requires express permission; users are responsible for violations

10. Limitation of Liability

• Platform is provided "as is" and no guarantee of continuous availability or security is provided
• LycheeLuxe is not responsible for user interactions, loss of profits, data, or indirect/consequential damages

11. Indemnification

Users agree to indemnify LycheeLuxe, affiliates, directors, and employees against claims, losses, or costs arising from:

• Platform use in violation of Terms
• Violation of third-party rights, including content involving minors

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the platform's country of headquarters, without considering conflicts of laws. Legal disputes will be resolved in courts of the headquarters' city/state. Local laws protecting minors and privacy (LGPD, GDPR, PDPA, CCPA, etc.) are respected regardless of headquarters.

13. Changes to Terms of Use

• LycheeLuxe may modify these Terms at any time
• Material revisions will be notified 30 days in advance, when possible
• Continued use constitutes agreement with revised Terms
